Welcome to ABA Schedule Pro, a product of ABA Study Companion LLC ("Company," "we," "us," or "our"). By creating an account or using our platform, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the platform.
ABA Schedule Pro is a web-based scheduling platform designed for Applied Behavior Analysis (ABA) clinics. It provides clinic management, staff and client scheduling, authorization tracking, and related tools. The platform processes protected health information (PHI) as defined by the Health Insurance Portability and Accountability Act (HIPAA).
You must be at least 18 years old and authorized to bind the clinic or organization on whose behalf you are creating an account. By registering, you represent that you have this authority.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for safeguarding your login credentials and for all activity under your account. You must notify us immediately at [email protected] if you suspect unauthorized access.
Your clinic retains full ownership of all data you enter into the platform, including client records, staff information, session data, and authorizations. We do not claim any ownership rights over your data. We access your data only as necessary to provide and improve the service, and as permitted under our Business Associate Agreement (BAA).
We act as a Business Associate under HIPAA when processing PHI on your behalf. Each clinic must execute a separate Business Associate Agreement (BAA) with us before entering any PHI into the platform. You are responsible for ensuring that your use of the platform complies with all applicable HIPAA regulations, including the Privacy Rule and Security Rule.
You agree not to:
Specific pricing, billing cycles, and payment terms will be communicated to you before your clinic is charged. We reserve the right to modify pricing with 30 days' advance written notice. Failure to pay may result in suspension or termination of your access.
Insurance claims: the Service can prepare and send insurance claims on your clinic's behalf, but your clinic remains solely responsible for the accuracy of all coding, diagnosis codes, modifiers, units, charges and provider information on each claim, and for following each payer's rules. Pre-checks in the Service are a convenience, not a guarantee that a claim is correct or will be paid.
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any downtime, data delays, or service interruptions caused by factors beyond our reasonable control.
Either party may terminate this agreement at any time by providing written notice to the other party. Upon termination:
To the fullest extent permitted by law, ABA Study Companion LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform. Our total liability for any claim arising from or related to these Terms shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.
The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
You agree to indemnify and hold harmless ABA Study Companion LLC and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the platform or violation of these Terms.
We may update these Terms from time to time. We will notify you of material changes via email or through the platform at least 30 days before they take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Texas.
